Terms of Service

1. Introduction

Welcome to Murmur. These Terms of Service ("Terms") govern your access to and use of the Murmur application and related services (collectively, the "Service") operated by Benri LLC ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

3. Account and Security

To use certain features of the Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

We use Supabase for authentication services. By creating an account, you also agree to Supabase's terms of service as they apply to authentication.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

  • Use the Service in any way that violates applicable laws or regulations
  • Record or upload content that infringes on the rights of others
  • Attempt to interfere with, compromise, or disrupt the Service
  • Use the Service to harass, abuse, or harm another person
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use automated systems or software to extract data from the Service

5. Voice Content and Intellectual Property

Your Content: You retain ownership of all voice recordings, transcripts, and other content you create using the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to process, store, and analyze Your Content solely to provide and improve the Service.

Our Service: The Service, including its design, features, and underlying technology, is owned by Benri LLC and protected by intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or branding.

6. AI Processing Disclosure

The Service uses artificial intelligence, specifically Google's Gemini, to:

  • Transcribe your voice recordings
  • Analyze transcripts to generate insights and summaries
  • Power the "Active Memory" feature for searchable context

Your recordings and transcripts are processed automatically by AI systems. We do not manually review your content unless required by law or to investigate a violation of these Terms. AI-generated insights are provided for personal reflection and should not be considered professional advice.

7. Third-Party Services

The Service integrates with third-party services to provide functionality:

  • Supabase: Authentication, database, and file storage
  • LiveKit: Real-time audio communication
  • Google Gemini: AI-powered transcription and analysis
  • Apple Push Notification Service: iOS notifications

These third-party services have their own terms and privacy policies. We are not responsible for the practices of these third parties.

8. Service Availability

We strive to maintain reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Technical issues or outages
  • Circumstances beyond our control

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.

9. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BENRI LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL BENRI LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Termination

You may terminate your account at any time by contacting us through our contact page. Upon termination, your right to use the Service will immediately cease.

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination, we will delete your data in accordance with our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or via email. Your continued use of the Service after such notice constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
